What the source record establishes
The Health Protection Law of 12 January 2024, No. 14, is an identified governing-law reference. FAOLEX provides a readable consolidation listing amendments through 21 January 2025. Its Article 104 addresses assisted reproduction and surrogacy.
The official Ministry of Justice law and procedure references were rechecked on 29 October 2026 but did not yield a complete readable operative record. We have not independently confirmed every later amendment, commencement provision or administrative interpretation.

Article 104: what the historical text actually says
The following is an editorial English summary of Article 104 in the FAOLEX consolidation through 21 January 2025, pages 66–67. It records the wording available in that historical source, not a confirmation that every provision remains unchanged today.
| Provision | What the readable text says | What it does not establish |
|---|---|---|
| 104(1) | Artificial fertilisation, embryo transfer and insemination are described with written consent of spouses or an unmarried woman. Sex selection is restricted, with an exception concerning a high probability of inherited disease. | A present-day admission decision for every applicant, nationality or donor arrangement. |
| 104(2)–(3) | Surrogacy is linked to medical indications and a notarised agreement. The text also addresses a married surrogate’s spouse’s consent and a licensed healthcare organisation’s agreement concerning pregnancy, birth and postpartum care. | That a coordinator’s commercial package replaces the required agreements or establishes current foreign access. |
| 104(4) | The text describes a surrogate aged 20–35 with at least one healthy child of her own, medical-genetic counselling and written informed voluntary consent. | A complete current screening protocol or the suitability of a particular person. |
| 104(6)–(9) | The text addresses pregnancy, birth and postpartum expenses, registration of the contracting person or persons as parents, and obligations concerning refusal or loss. | An all-inclusive price, automatic recognition abroad or a complete current civil-registration checklist. |
| 104(10)–(11) | The text restricts commercial, military and industrial uses of reproductive material and delegates ART conditions, restrictions and gamete-donation procedure to the Cabinet of Ministers and licensed providers. | That a donor catalogue or material invoice defines every lawful use. |
| 104(12) | The text restricts advertising of surrogacy-support providers lacking Kyrgyz registration and the relevant licences, and searching for citizens as surrogates for foreign citizens living outside Kyrgyzstan. | That foreign arrangements are unrestricted; this provision needs current-text and case-specific interpretation. |
Read the law, procedure and practice together
An enabling law, implementing procedure, professional licence and birth-registration process answer different questions. A contract or a clinic acceptance letter cannot replace all of them.
Resolution 616 of 14 October 2024 is an identified ART/surrogacy procedure reference. The full current text, amendments and interaction with the governing law still need verification before extracting a definitive national admission checklist.

- Which changes have been adopted, officially published and commenced?
- Which authorities control treatment, contracting, registration and subsequent documents?
Policy record and proposed changes
The parliament’s Bill 5007 public-consultation page identifies a proposed amendment to the Health Protection Law, published on 10 August 2026 under reference No. 1-12662/Сл. It names Chyngyz Azhybaev and Bolot Ibragimov as initiators and marks the public discussion closed. These details were read from the rendered official page on 29 October 2026.
The attached draft proposes adding a paragraph to Article 104(2) restricting surrogacy contracts to Kyrgyz citizens, while stating that a Kyrgyz citizen officially married to a foreign citizen may use surrogacy. Its Article 2 proposes commencement ten days after official publication. These are draft provisions; no actual commencement date is established here. A closed consultation is not proof of adoption, official publication or commencement. The source record here does not establish the final enacted wording, later amendments or transitional treatment of existing arrangements. Match any claimed new restriction to the relevant final legal document and effective date.
The January 2025 consolidation, the October 2024 procedure reference and the August 2026 consultation are different records. They should not be combined into a single supposed current rule.
What a case-specific conclusion should contain
A qualified legal review should name the parties, nationality, residence, family circumstances, medical indication, intended genetic relationship and proposed service providers. It should identify applicable provisions and explain unresolved interpretation.
This source record does not approve an arrangement and has not been reviewed by a Kyrgyz lawyer. A statement that a clinic offers a programme remains a provider statement.
